1. Definitions

'Riviera Cars' refers to the Company named Riviera Executive Cars Limited (Company reg. number 07921483), whose registered office is;

'You' and 'Your' means and refers to any company, other business or any individual who places a booking with us, whether for themselves or on behalf of other individuals.

2. Booking

2.1 It is your responsibility to ensure that the vehicle requested allows enough comfort and space for the volume of passengers and items of luggage you may have. Wheelchair accessible vehicle bookings must be specified at the time of booking.
2.2 It is your responsibility to ensure that enough time is allowed for the journey required and Riviera cars cannot be held responsible for any unforeseen delays to the journey such as traffic, weather or circumstances beyond our control or if passengers are not ready at the time of collection.
2.3 It is your responsibility to ensure that the expected time of arrival is correct and that the correct terminal has been given, Riviera cars cannot be held responsible for the ETA arrival information provided by the airlines being accurate when checking ETA arrival information. Riviera cars will check with the airlines for flight delays or alterations before the driver leaves for the airport but if unable to for whatsoever reason we cannot be held responsible if the flight is delayed or arrives early. You will still be responsible for payment of the journey unless you have contacted our office in advance.
2.4 Riviera cars will provide you with a quotation based on the information provided at the time of booking. Riviera cars will amend the quotation if there is any material change to the original booking without prior knowledge.
2.5 Riviera cars will not be held responsible for any delays or costs arising from your failure to provide us with correct booking information.

3. Prices & Payments

3.1 All airport prices are based on one collection pick up point and one drop off point, any additional stops will be charged accordingly.
3.2 Car parking charges, tolls or drop off fees are in addition to the prices quoted.
3.3 The collection fare for airports includes car park fee with an initial 30 minutes waiting time included. Waiting time, if incurred will be charged at £18.00 per hour in 15-minute increments for all vehicle types. This will begin 30 minutes from the originally scheduled flight arrival time.
3.4 No charge will be made to a credit/debit card until the journey is completed unless advised at the time of booking or when booking online.
3.5 Credit/Debit card details will be required on all long distance/outside area/return booking journeys as security for the driver.
3.6 A £5.00 surcharge is made each way for storing all child seats.
3.7 Riviera cars reserve the right to request Identification from a passenger when booking with credit/debit cards.
3.8 Management reserve the right to charge an administration fee if a booking is cancelled through no fault of our own and at the request of the customer. The amount charged is at the discretion of The Management team.

4. Cancellation

4.1 If you need to cancel your booking, please contact Riviera cars as soon as possible. If the vehicle has already been dispatched then a charge will be incurred equal to the distance travelled by the driver to the collection point. If a charge is then made to a credit or debit card held as security only, this charge will incur a 5% surcharge.
4.2 A refunds policy will only be offered on a discretionary basis following a letter of dissatisfaction with the service provided. In the event that Management agrees a payment is to refunded, Riviera cars will make the refund back to the credit/debit card from which the original payment was made within 48 hours. A cheque will be made to the named cardholder only if this service is unavailable.
4.3 Management reserve the right to charge an administration fee if a booking is cancelled through no fault of our own and at the request of the customer. The amount charged is at the discretion of The Management team.

5. Conduct

5.1 Smoking, drinking and eating is not permitted in the vehicles. You will be charged £80.00 to cover valeting costs in the unlikely event of the vehicle being soiled by a passenger.
5.2 Riviera cars are permitted by law to carry only passengers as allowed by the licence and insurance. Your journey will be refused if passengers are in excess of the allowance.
5.3 Riviera cars are only permitted to take passengers through booked only jobs.
5.4 You will be held responsible for the behaviour of each passenger in the vehicle during the journey. You will indemnify Riviera cars against all losses, expenses, costs or damages caused by the actions of a passenger you are responsible for.

6. Termination

6.1 Riviera cars have the unconditional right to terminate or refuse any booking with immediate effect when it places the driver at risk of abuse, violence or damage by either you or any passenger for whom you are responsible. No refunds will be given under any circumstances if the journey is terminated in this respect part way through the hire.

7. Liability

7.1 All luggage items are carried entirely at your own risk.
7.2 Riviera cars will not be responsible for installing baby or child seats into a vehicle. This is the responsibility of the parent or person responsible for the child at the time of the journey.
7.3 Riviera cars have the right to cancel all services and provide refunds in the event of extenuating circumstances beyond our control such as terrorist attack, riot, national emergency, national disaster or war.
7.4 Riviera cars will endeavour to arrange an alternative vehicle as soon as is practical in the event that your vehicle breaks down and get you to your destination. Riviera cars will not be held responsible for any losses, costs, expenses or damages resulting from the breakdown of a vehicle.
7.5 Riviera cars will endeavour to get you to your destination on time, we cannot be held responsible for any losses whatsoever for conditions such as heavy traffic that are beyond our control during the journey. There is no circumstance under which any factors out of our control will cause A1 Cabco Taxis to be liable for any personal loss or business loss whatsoever such as loss of profits.

8. Miscellaneous

8.1 Under this agreement, Riviera cars can subcontract its obligations. You shall not assign, transfer or delegate any of your rights or obligations under this agreement.
8.2 Riviera cars shall store, process and use all information regarding your personal details in accordance with the Data Protection Act 1998.
8.3 Riviera cars reserve the right to amend these terms and conditions at any time. You are responsible for reviewing these conditions periodically to ensure that you are aware of any changes posted online.
8.4 This agreement and any accompanying price quotation represent the entire agreement between you and Riviera cars in relation to its subject matter. If there is any discrepancy between the terms of this agreement and the quotation, then the terms of this Agreement shall prevail.
8.5 Nothing in this Agreement is intended to confer any benefit on any third party, whether pursuant to the Contracts (Rights of Third Parties) Act 1999 or otherwise, and no third party shall have the right to enforce any rights under this Agreement except where otherwise agreed in writing.

Disputes

This agreement shall be construed in accordance with English Law and you and Riviera cars each agree to submit to the exclusive jurisdiction of the English Courts in respect of any dispute or claim arising out of or in connection with this agreement.

BY USING THIS SERVICE, YOU AGREE TO THESE TERMS WHICH WILL BIND YOU. IF YOU DO NOT AGREE TO THESE TERMS, YOU WILL BE PROHIBITED FROM USING RIVIERA CARS BOOKING APP.

We, Riviera Executive Cars Limited of Taplow Railway Station, Approach Road, Taplow, Buckinghamshire, SL6 0NP licence you to use Riviera cars App (version [Apple: 12.4.3 and above, Android: 20.10.1 and above) mobile application software, the data supplied with the software and any updates or supplements to it or the online booking website (‘Riviera cars’), as permitted in these terms (‘Licence’).

The Riviera cars App mobile application software requires a smartphone device with relevant software and sufficient memory.

A copy of this Licence is available on our website or on the mobile application.

Grant and scope of licence

We grant you a non-exclusive, non-transferable licence to use Riviera cars App in the UK on the terms of this Licence. We (or our licensors) remain the owners of Riviera cars App at all times.

We are an intermediary between you and the provider to you of transport services by licensed drivers (‘transport provider’) and we do not provide transport services directly. You are able to use Riviera cars App to book a transport provider for a fee, subject to the length of the journey plus waiting time.

Riviera cars booking App accept your booking and allocate this to the transport provider. Any fee is payable by cash to the transport provider or by card payment via the app or website to Riviera cars.

You may not copy, distribute, unzip, reverse engineer, decompile or otherwise disassemble, rent, lease, sub-licence, adapt, vary or modify Riviera cars App. You may not remove any copyright or trademark.

USE OF Riviera cars booking App

Following acceptance of these terms and conditions, you must register and set up an account on Riviera cars App. Registration requires you to submit your name, an up to date address, mobile phone number, email address and your age. You are able to amend certain information on Riviera cars App or by contacting the administrator.

You must register a debit or credit card to Riviera cars App in order to continue with the download of Riviera cars App. This will be stored on Riviera cars App and we shall only charge your debit or credit card in the event of payment authorised by you after using the transport provider or upon cancellation in accordance with the cancellation terms below.

Riviera cars App will make every effort to complete your booking within the requested time however this is not always possible to achieve. You acknowledge that the fare estimate and estimated time of arrival are approximations only and the actual fare and time of arrival are subject to traffic levels, the weather and the availability of transport providers.

INTELLECTUAL PROPERTY

You acknowledge that all intellectual property rights in Riviera cars App belong to us (or our licensors), that rights in Riviera cars App are licensed (not sold) to you, and that you have no rights in, or to, Riviera cars App other than the right to use it in accordance with the terms of this Licence.

Limitation of liability as a consumer user

You acknowledge that Riviera cars App has not been developed to meet your individual requirements.

We only supply Riviera cars App for domestic and private use. You agree not to use Riviera cars App for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We are only responsible for loss or damage you suffer that is a foreseeable result of our breach of this Licence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if they were an obvious consequence of our breach or if they were contemplated by you and us at the time we granted you the Licence.

We are not responsible for any failure of the transport provider to carry out the booking and the transport provider is not a guaranteed service. All of the transport providers are licensed but may not be licensed in the area in which the booking is requested or the service is to be provided and you use the transport provider at your own risk.

Nothing in this Licence shall limit or exclude our liability for death or personal injury resulting from our negligence.

HOW WE MAY USE YOUR PERSONAL INFORMATION

During the registration process, you will be required to provide us with personal information in order to enable Riviera cars App to function. This information will be stored safely and securely on Riviera cars App. We will use the personal information you provide to us to facilitate communication between you and the transport provider, to monitor usage of Riviera cars App and to process your payment following use of a transport provider.

We may collect location data sent from your devices. You consent to us processing and using your location data. You may stop us collecting such data at any time by turning off the location services settings.

You will have the opportunity to restrict Riviera cars App from accessing certain parameters of your mobile device(s) however you acknowledge that this may directly or indirectly impede the functioning of the service.

We will implement appropriate technical and organisational measures to protect any personal data against unauthorised or unlawful processing and accidental loss or damage.

We will only give your personal information to third parties where the law either requires or allows us to do so.

Cancellation

In the event that you use Riviera cars App to book a transport provider and then do not use the transport provider, you authorise us to charge your debit or credit card a standard cancellation fee to cover the cost of administering the booking and subsequent cancellation. The amount of the cancellation fee is subject to the tariff and the district as follows:-

cancellation of the transport provider in the Royal Borough Maidenhead & Windsor district between the hours of [07:00 and 00:00, Monday to Saturday], shall be charged at tariff 1 (£5) and between the hours of [00:00 and 07:00 Monday to Saturday, all day Sunday and Public/Bank Holidays, between the hours of 18:00 and 00:00 Christmas Eve and New Year’s Eve] shall be charged at tariff 2 (£8);

The cancellation fee shall be payable upon each booking which is made and subsequently cancelled. A minimum charge of the relevant tariff will be applied if you have pre-booked and cancelled in less than 60 mins of the dispatch time. A minimum charge of the relevant tariff PLUS mileage will be charged if the transport provider has already been dispatched.

Termination of Riviera cars App

We may terminate this Licence at any time without notice. We may also block your use of Riviera cars App if you breach these terms and conditions.

You may terminate this Licence by deleting Riviera cars App from your mobile or another device (s).

Upon termination for any reason:

all rights granted to you under this Licence shall cease;

you must immediately cease all activities authorised by this Licence; and

we will immediately deduct any sums due to us under this Licence; and

you must immediately delete or remove Riviera cars App from all mobile devices or computer equipment in your possession.

Events outside our control

We will not be liable or responsible for any failure to performance or delay in performance of, any of our obligations under this Licence that is caused by an Event Outside Our Control. An "Event Outside Our Control" means any act or event beyond our reasonable control, including without limitation failure of public or private telecommunications networks.

Other important terms

We may transfer our rights and obligations under this Licence to another organisation, but this will not affect your rights or our obligations under this Licence.

We reserve the right to change pricing or cancel web booker and App booking at any time without any prior notice.

Each of the conditions of this Licence operates separately. If any court or competent authority decides that any of them are unlawful or unenforceable, the remaining conditions will remain in full force and effect.

As a consumer, please note that this Licence, its subject matter and its formation, are governed by English law. You and we both agree to that the courts of England and Wales will have non-exclusive jurisdiction.

Card pre-authorisation: This is not a charge and it will be removed from your bank statement. Depending on the financial institution, this will take anywhere between minutes and few weeks.
This amount corresponds to a pre-authorisation. These are reserved funds that are put on hold by your card issuer, and they are performed to attempt to confirm the card information entered is valid and the bank will allow your transaction. The usual amount is £1.01, but it may vary depending on the business requirements.

Sometimes when you are registering your card in an app or website, you will see the same pre-authorisation. In this case, this is referred to as card verification.
If you have further questions about how your bank handles pre-authorisations, We advise you to contact them directly.

CHANGES TO TERMS AND CONDITIONS

We reserve the right to amend these terms and conditions from time to time. You will be notified when there is a change to terms and conditions and you will be required to agree to any amendments. In any event, your continued use of Riviera cars App constitutes acceptance of such changes.
